Qanun Jenayah Syariah: Hukuman qisas dan diyat bagi jenayah bunuh, cederakan manusia
HUKUMAN qisas adalah sama seperti hukuman hudud juga, iaitu hukuman yang ditentukan dan ditetapkan Allah hukumannya di dalam Quran dan hadis yang wajib dikenakan ke atas penjenayah yang sabit kesalahannya di dalam mahkamah.
Hukuman qisas ialah kesalahan yang dikenakan hukuman balas. Membunuh dibalas dengan bunuh (nyawa dibalas dengan nyawa), melukakan dibalas dengan luka, mencederakan dibalas dengan mencederakan.
Kesalahan yang wajib dikenakan hukuman qisas ialah membunuh orang lain dengan sengaja, menghilang atau mencederakan salah satu anggota badan orang lain dengan sengaja dan melukakan orang lain dengan sengaja.
Hukuman membunuh orang lain dengan sengaja wajib dikenakan hukuman qisas ke atas si pembunuh dengan dibalas bunuh. Firman Allah SWT, "Wahai orang yang beriman. Diwajibkan kamu menjalankan hukuman qisas (balasan yang seimbang) dalam perkara orang yang mati dibunuh." (Surah Al-Baqarah: 178)
Hukuman menghilangkan atau mencederakan salah satu anggota badan orang lain atau melukakannya wajib dibalas dengan hukuman qisas mengikut kadar kecederaan atau luka seseorang itu juga mengikut jenis anggota yang dicederakan dan yang dilukakan tadi.
Firman Allah, "Dan kami telah tetapkan atas mereka di dalam Kitab Taurat itu, bahawasanya jiwa dibalas dengan jiwa, dan mata dibalas dengan mata, dan hidung dibalas dengan hidung, dan telinga dibalas dengan telinga, dan gigi dibalas dengan gigi, dan luka-luka juga hendaklah dibalas (seimbang). Tetapi sesiapa yang melepaskan hak membalasnya, maka menjadilah ia penebus dosa baginya. Dan sesiapa yang tidak menghukum dengan apa yang telah diturunkan oleh Allah, maka mereka itulah orang-orang yang zalim." (Surah Al-Ma'idah: 45).
Hukuman diyat ialah harta yang wajib dibayar dan diberikan penjenayah kepada wali atau waris mangsanya sebagai ganti rugi disebabkan jenayah yang dilakukan penjenayah ke atas mangsanya. Ia adalah hukuman kesalahan yang sehubungan dengan kesalahan qisas yang ditetapkan Allah dan Rasul di dalam Quran dan hadis sebagai ganti rugi di atas kesalahan membabitkan kecederaan anggota badan, atau melukakannya.
Firman Allah, "Maka sesiapa (pembunuh) yang dapat sebahagian keampunan dari saudaranya (pihak) yang terbunuh) maka hendaklah (orang yang mengampuni itu) mengikut cara yang baik (dalam menuntut ganti nyawa), dan si pembunuh pula hendakalah menunaikan (bayaran ganti nyawa itu) dengan sebaik-baiknya. Yang demikian itu adalah suatu keringanan dari tuhan kamu serta rahmat kemudahan. sesudah itu sesiapa yang melampaui batas (untuk membalas dendam pula) maka baginya azab siksa yang tidak terperi sakitnya." (Surah Al -Baqarah: 178)
